    Terms of Service

    These Terms of Service ("Terms") govern your access to and use of MusicMake.ai and its related features, including AI music generation, lyrics tools, uploads, sharing, subscriptions, credit packs, certificates, and support services (together, the "Service").

    By creating an account, buying a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

    Who Can Use the Service

    You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you use the Service on behalf of a company, team, or other entity, you confirm that you have authority to bind that entity to these Terms.

    You are responsible for:

    • keeping your login credentials secure;
    • providing accurate account information;
    • all activity that happens through your account unless caused by our own fault.

    What the Service Does

    MusicMake.ai helps users create, edit, process, store, and download AI-assisted music and related outputs. Features, limits, generation speed, commercial rights, file formats, storage, and certificates may vary by plan, region, product surface, or promotional offer.

    We may change, improve, or retire features over time.

    Plans, Credits, Billing, and Renewals

    Subscriptions

    • Paid subscriptions renew automatically until you cancel.
    • You can cancel from your billing portal, billing settings, or another method we make available.
    • Cancellation stops future renewal charges and normally takes effect at the end of the current billing cycle.
    • Unless we say otherwise in writing, fees already paid for the current billing cycle are not prorated.

    Credit Packs and Usage

    • Some actions require credits or usage allowances.
    • Credits have no cash value, are not transferable, and cannot be redeemed for money.
    • Promotional, bonus, trial, or subscription credits may have separate expiry or priority rules.
    • We may correct obvious pricing, billing, or crediting errors.

    Taxes and Price Changes

    • Prices may change in the future.
    • If the law requires advance notice before a renewal price changes, we will provide that notice.
    • You are responsible for taxes, duties, or similar charges unless the law says otherwise.

    Your Content and Your Outputs

    Your Inputs

    You keep ownership of the content you submit to the Service, such as prompts, lyrics, reference audio, and uploads ("Inputs"). You give us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, modify, and transmit those Inputs only as needed to operate, secure, improve, and support the Service.

    Generated Outputs

    As between you and us, you own the music and other outputs you generate through the Service to the extent permitted by applicable law and subject to:

    • any third-party rights in material you upload or reference;
    • any plan-specific licensing limits shown at purchase or in product documentation;
    • your compliance with these Terms and applicable law.

    Similarity and AI Limits

    AI systems can generate similar or overlapping results for different users. We do not guarantee that any output will be unique, copyrightable, or free from third-party claims. You are responsible for reviewing and clearing your outputs before commercial release, distribution, or public use.

    Public Sharing

    If you mark a work as public, publish it, or otherwise choose to share it through the Service, you give us a non-exclusive license to host, display, distribute, promote, and feature that work within the Service and our marketing channels unless you later remove or make it private where that option exists.

    Certificates and Commercial Statements

    Any ownership, copyright, or commercial-use certificate we provide is a product document for your records. It is not government registration, legal advice, or a guarantee that a court, platform, distributor, or rights claimant will agree with your position.

    Acceptable Use

    You may not use the Service to:

    • break the law or infringe another person's rights;
    • upload or generate content you do not have permission to use;
    • impersonate others, commit fraud, or misuse payment systems;
    • spread malware, spam, abusive material, or unlawful content;
    • bypass security controls, rate limits, queues, or plan restrictions;
    • scrape, reverse engineer, or interfere with the Service except where law clearly allows it;
    • use automated methods to overload, probe, or attack our systems.

    We may investigate misuse and may remove content, suspend features, cancel orders, or terminate accounts that violate these Terms.

    Third-Party Services

    Parts of the Service rely on third-party providers such as authentication, payments, analytics, hosting, storage, and AI processing services. Those providers may have their own terms and privacy policies, and we are not responsible for products or services they provide directly to you.

    Intellectual Property

    The Service itself, including our software, branding, design, documentation, and site content, is owned by MusicMake.ai or our licensors and is protected by applicable intellectual-property laws. These Terms do not give you any ownership in our Service, trademarks, or brand assets except for the limited right to use the Service as allowed here.

    Suspension and Termination

    You may stop using the Service at any time. We may suspend or terminate your access if:

    • you violate these Terms or applicable law;
    • your use creates security, fraud, abuse, or legal risk;
    • we are required to do so by law or by a service provider;
    • we stop offering the Service.

    Termination does not cancel obligations that already arose, including payment obligations, license grants needed to run the Service, dispute provisions, and limits on liability.

    Disclaimers

    The Service is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

    We do not promise that:

    • the Service will always be available, fast, or error-free;
    • any output will be unique, accurate, legally safe, or suitable for your intended use;
    • any certificate, commercial-rights statement, or platform guidance will satisfy every distributor, marketplace, or legal authority.

    Limitation of Liability

    To the maximum extent permitted by law:

    • we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities;
    • our total liability for any claim relating to the Service will not exceed the amount you paid us for the specific Service giving rise to the claim in the 12 months before the claim arose.

    Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

    Indemnity

    You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, and expenses arising out of:

    • your Inputs or outputs;
    • your use of the Service;
    • your breach of these Terms;
    • your violation of law or third-party rights.

    Changes to These Terms

    We may update these Terms from time to time. If we make a material change, we will post the updated Terms and may provide additional notice. By continuing to use the Service after the updated Terms take effect, you agree to the revised Terms.

    Governing Law and Disputes

    Unless mandatory consumer law says otherwise, these Terms are governed by the laws of the jurisdiction where the operator of MusicMake.ai is established, without regard to conflict-of-law rules.
